New Leave Entitlement for Family and Domestic Violence

Family and domestic violence leave has now been added to the National Employment Standards, and applies to ALL employees in the Fair Work System from 12 December 2018.

This new entitlement allows employees to access up to 5 days of UNPAID leave each year to do something that will help them to deal with the impact of family or domestic violence if it is unpractical to do so outside their ordinary hours of work.

This includes taking time off to:

  • Make arrangements for personal safety or for the safety of a family member
  • Attend any court hearings
  • Access police services

The 5 days will renew every 12 months but does not accumulate from year to year if it is not used.
